Spooktacular Show | Professor Curt Benson and Attorney Mike Dunn discuss the still unsolved case of Jack the Ripper, the mad man who, in 1888, tore his way through the foggy London streets brutally (but skillfully) slicing up at least five women within a square mile area near the districts of Whitechapel, Spitalfields, Aldgate, and the City of London proper. Our spooky journey continues. We cross the big pond to America and explore the infamous Salem Witch Trials. This was a bleak and mysterious spot in our history as witching hysteria overcame a small town in Massachusetts in the 1690's. Wait until you here about "spectral evidence." We discuss Lizzy Borden. She was acquitted in 1893 of killing her parents because she was a girl. Curt and Mike explain how this case is still significant. We also consider the 1962 - 1964 case of the Boston Strangler, and why that case is still so puzzling. The Lawyers have an update on a sad news story they discussed at length in January of 2007. The Sacramento radio station, KDND, as part of its "Morning Rave" program, held an on-air contest--"Hold Your Wee for a Wii." The person who drank the most water without urinating would win a Nintendo Wii video game console. Twenty-eight year old Jennifer Lea Strange really wanted to win the game for her two kids. She died as a result. The technical term is hyponatremia, otherwise known as water intoxication. Her family sued the radio station and a jury returned a verdict of $16 frac12; million. The Lawyers discuss it. | 11/1/09 | Free | View In iTunes |

We scatter our legal feelers over the landscape & have highlighted the best legal issues in this edition of Cooley Law Schools | This week, Curt Benson and Mike Dunn discuss the HAPPY Act aka the Humanity and Pets Partnered Through the Years. a piece of legislation proposed by U.S. Rep. Thaddeus McCotter, R-Mich. that would grant every household in the land a $3,500 tax deduction for "qualified pet care expenses." The Lawyers discuss the legal ramifications in pet ownership. So exactly how do you prove that Fido is your beloved friend to the end? Or is he really just a junkyard dog you took a picture of in order to get the tax credit? Parenthetically, Fido is little more than another piece of the furniture in the eyes of the law. The Lawyers will also dismantle the antics of Balloon Boy, Falcon Heene, the 6-yr-old who was thought to have floated away in the family's giant Mylar balloon. Richard Heene, the boys' father has been accused of creating the story and using his son as a publicity stunt after the boy made an odd confession on CNN's "Larry King Live" on Thursday night. Heene asked Falcon why he had not come out from hiding when his parents were calling for him. "You guys said we did this for the show," the boy said. What are the legal ramifications when children are used for fame and publicity by their parents? Speaking of kids, 6-yr-old Zach Chrisite has been reinstated after national media attention forced his 45-day suspension in reform school ruling to be thrown out by the local school board. Zach brought a camping knife and spoon set to school #38; his school has a zero tolerance policy on such behavior, even for 6 yr-olds. The Lawyers discuss the semantics of school rules. Curt and Mike discuss Rush Limbaugh's grounds for a libel suit as his bid for a National Football league team were allegedly sacked because of quotes he purportedly made regarding slavery. What are his chances and would he do it? The Lawyers sound off as to why he may file such a lawsuit and what constitute libel #38; slander. We also look into the suspicious deaths of three people who participated in a sweat lodge in Arizona. Although three people died unexpectedly, but there may be no law to prosecute the person who ran the sweat lodge, Curt and Mike explain. Judge Markey penned the decision that held the defendantrsquo;s Constitutional rights were violated, a decision later reversed by the Michigan Supreme Court. So who was right? Is it Judge Markey or the Michigan Supreme Court? The United States Supreme Court, the final arbiter, will decide. The Lawyers ask Judge Markey how she feels about the prospect of nine Justices of the Supreme Court analyzing the correctness of her legal reasoning. (She acts calm and judicio us, but The Lawyers can tell shersquo;s freaked out.) Professor Benson and Attorney Dunn also review the big cases the Supreme Court will decide this term. And Professor Benson has a prediction: Will a Justice retire this term? You may be surprised at the answer.
