Otero is premised upon the fact that by statute, ? 26-1-108, C.R.S. 1973, the State Department of Social Services has the power to "adopt rules governing fiscal and personnel administration for county departments." The court there reasoned that to permit the Board of County Commissioners of each county to challenge the right of the State Board to enact its rules "would serve as an impediment rather than a convenience."
