After a jury convicted appellant of the felony offense of credit card abuse under TEX. PENAL CODE ANN. ? 32.31(b)(2), the trial judge sentenced him to ten years in prison, probated for ten years, and imposed a $2,000 fine. Upon direct appeal, the First Court of Appeals affirmed appellants conviction and sentence with one justice dissenting. Olurebi v. State, 818 S.W.2d 851 (Tex. App.--Houston [1st Dist.] 1991). We granted appellants petition for discretionary review to determine the meaning of the term "fictitious credit card" as it is used in TEX. PENAL CODE ANN. ? 32.31(b)(2). See TEX. R. APP. P. 200(c)(2) & (5). We will vacate the judgment of the Court of Appeals and remand the cause for a harm analysis.
