CRIMINAL LAW, BURGLARY ? TRIAL ? PLEA. 1. Criminal Law ? Burglary ? Change of plea. A change of plea is a matter that rests in discretion of trial court and is subject to review only in case of abuse of discretion, but each case must depend upon its own facts and circumstances, and when application is made to change plea all doubts should be resolved in favor of trial on merits, and discretion of court should be liberally exercised in favor of life and liberty. - Page 59 2. Criminal Law ? Burglary ? Defendant entitled to change plea. In prosecution for burglary wherein sentence of two years imprisonment was imposed, evidence established that defendant at time of entry of plea of guilty, without aid of counsel, felt he had understanding that he would receive suspended sentence and defendant was entitled to change plea to not guilty.
