This is an appeal from a judgment following an order sustaining the defendants demurrer to the complaint without leave to amend. The action is based on the alleged negligence of Emerald J. Steen when her automobile, in which the plaintiff was riding as a passenger, collided with a truck. The collision occurred on April 24, 1947. Thereafter Emerald J. Steen died. The action was commenced on January 9, 1948, against the administrator of her estate after the rejection of a claim.
