La forma presa sul serio

L’idea di fondo del saggio è che per superare le secche di uno sterile conflitto tra formalismo e antiformalismo, occorre cambiare punto di visto e concepire la forma come qualcosa allo stesso tempo più profondo e più complesso rispetto a quanto coloro che si scagliano contro il formalismo siano disposti ad ammettere. Questo intendo per ‘orma sul serio’ oltre a parodiare un po’ I diritti di Dworkin. Pertanto, non deve sembrare un paradosso che nel libro si difenda strenuamente il formalismo e allo stesso tempo si sostenga non solo che talvolta l’illegalità praticabile (una decisione non annullabile a dispetto dell’essere stata assunta in violazione delle formalità procedurali) è compatibile con il prendere la forma sul serio, ma che questo è persino desiderabile se si aderisce all’ideale dello stato di diritto.


[The idea which underpins this book is that to overcome the shallows of the conflict between formalism and anti-formalism, one has to change perspective and look at form as something at the same time deeper and more complex than those who assault formalism seem prepared to accept. This I mean by ‘taking form seriously’, as well as mocking Dworkin’s rights a little bit. So it must not seem paradoxical that in the book I strenuously defend formalism while purporting not only that sometimes useful unlawfulness (meaning that a decision must stand in spite of its having been issued in violation of procedural or other formal requirements) is compatible with taking form seriously but that this is even desirable if we adhere to the ideals of the rule of law.]
