Course Description

This course builds upon knowledge acquired in Contracts A and Contracts B and applies the statutory framework applicable to commercial and consumer contracts particularly the Sale of Goods Act 1896 (Qld) and relevant provisions of the Australian Consumer Law 2010 (Cth). Commercial law is essentially concerned with personal property and therefore includes an examination of bailment; restrictive trade practices; electronic commerce and negotiable instruments; agency; consumer credit; personal property securities and bankruptcy; intellectual property; insurance; business organisations and superannuation.

Learning Outcomes
On successful completion of this course, you will be able to:

  1. Use clear and appropriate legal terminology and style to demonstrate an understanding of the fundamental concepts of commercial  law;
  2. Demonstrate proficient legal research skills to locate and identify both primary and secondary sources of commercial law;
  3. Read and understand legal material consistent with  course content
  4. Identify, define, apply and critically analyse relevant case law and legislation to a practical commercial law problem including identifying obligations, rights and remedies;
  5. Critically evaluate case law and legislation in constructing a coherent, logical and creative answer to a commercial law problem; and
  6. Apply and enhance the skills developed in other law courses to the discipline of commercial law.
