Order Dismissing Appeal Without Prejudice When this case was called for oral argument on January 28, 1994, the court took up the motion of the appellant to extend temporary relinquishment of jurisdiction. After presentation and in discussion with counsel for the appellant and counsel for the state, counsel for the appellant elected to request dismissal of the present appeal without prejudice to the further amended motion raising an additional claim for post-conviction relief in the trial court so that the additional claim yet to be litigated might be brought up for review by the court in one proceeding. Counsel for the State of Florida agreed to such a proceeding in order to ultimately expedite the disposition of the claim's before the court. Accordingly, the motion as aforesaid is granted on the bases recited. It is so ordered.
