Publisher Description

This is a third-party action under the Workmens Compensation Act, sec. 102.29 (1), Stats. Plaintiff received workmens compensation benefits for his injuries from his employer, Waukesha Asbestos Company, and brought this suit in negligence against the Wisconsin Electric Power and the Quality Aluminum Casting Company. The defendants denied negligence and served third-party complaints against Joseph Moran, a fellow employee of the plaintiffs, alleging that he negligently caused the plaintiffs injuries. The complaint of the Wisconsin Electric Power Company sought indemnity and, in the alternative, contribution, whereas the complaint of Quality Aluminum Casting Company was for contribution only.
