Defendant made two motions for judgment notwithstanding the verdict or a new trial. Both were denied. The second was not heard until after the time for appeal from the order denying the first had expired. The latter order in the meantime had not been vacated or suspended. The order denying the second motion was, therefore, in effect an order refusing to vacate an appealable order and so not appealable.
