Publisher Description

These consolidated appeals arise from the district courts order granting Larry Thornocks motion for summary judgment. The Washington Insurance Guaranty Association ("WIGA") appeals the part of the order requiring it to honor a settlement agreement entered into by Thornock and Mission Insurance Company before Mission was declared insolvent. WIGA argues that the settlement is not a "covered claim" under Washingtons insurance guaranty law. Thornock cross-appeals the district courts ruling that WIGA does not have to pay him interest on the settlement amount. The district court had jurisdiction over this diversity matter under 28 U.S.C. § 1332. We have jurisdiction under 28 U.S.C. § 1291, and we affirm in part and reverse in part.
